Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of www.frugalcoyote.org (the “Site”) and any online services offered by Frugal Coyote. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Frugal Coyote

Frugal Coyote is a nonprofit thrift store serving Borrego Springs and the surrounding community. The Site provides information about our organization, store, merchandise, donation opportunities, community programs, and related services.

2. Use of the Site

You may use the Site only for lawful, personal, and noncommercial purposes. You agree not to:

• Interfere with the Site’s operation or security.

• Attempt to gain unauthorized access to the Site or its systems.

• Introduce viruses, malicious code, or other harmful material.

• Use automated tools to collect information without permission.

• Misrepresent your identity or provide false information.

• Use Site content in a way that infringes another person’s rights.

• Engage in fraudulent, abusive, or unlawful activity.

 

We may restrict or discontinue access to the Site when reasonably necessary to protect Frugal Coyote, its visitors, or its systems.

3. Merchandise and Product Information

Much of Frugal Coyote’s merchandise is donated, previously owned, vintage, or unique. Normal wear, age, repairs, imperfections, or variations may be present.

We make reasonable efforts to describe and photograph merchandise accurately. However, we cannot guarantee that descriptions, measurements, colors, photographs, condition assessments, prices, or other information will always be complete or error-free. Screen settings may also affect how colors appear.

Unless otherwise stated, previously owned merchandise is offered in its existing condition. Customers should review available descriptions and inspect merchandise before completing a purchase whenever possible. Nothing in these Terms limits any rights or remedies that cannot legally be excluded.

4. Availability and Pricing

Merchandise is subject to availability and may sell without notice. Adding an item to a cart, wish list, or inquiry form does not reserve it unless Frugal Coyote expressly confirms otherwise.

 

Prices, promotions, and availability may differ between the Site and the physical store. We may correct pricing, inventory, or description errors and may cancel or decline a transaction affected by an error. If payment has already been collected for a canceled transaction, the amount paid will be refunded.

5. Purchases and Payment

If online purchasing is available, you agree to provide current and accurate billing, payment, pickup, delivery, and contact information.

Submitting an order does not guarantee acceptance. Frugal Coyote may decline or cancel an order because an item is unavailable, information is inaccurate, payment cannot be processed, fraud is suspected, or fulfillment is not reasonably possible.

Payments may be processed by third-party providers subject to their own terms and privacy policies. Applicable taxes and disclosed fees will be added when required.

6. Pickup, Delivery and Shipping

Pickup only at this time. Customers are responsible for providing accurate contact information and for collecting pickup orders within any communicated timeframe.

7. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by the policy disclosed at the physical store, on the applicable product page, or during physical checkout. Different policies may apply to in-store purchases, furniture, electronics, clearance merchandise, or other categories.

 

Please review the applicable policy before completing your purchase. Nothing in these Terms limits rights provided by applicable law.

8. Donations of Goods

Frugal Coyote may accept or decline donated items based on their condition, safety, storage requirements, resale potential, and the organization’s current needs. Acceptance of a donation does not guarantee that an item will be sold, used for a particular purpose, or retained.

 

Once accepted, donated goods become the property of Frugal Coyote and may be sold, recycled, transferred, repurposed, or otherwise handled in support of the organization’s mission.

 

When available, donation receipts will describe the donated property but generally will not assign a monetary value. Donors are responsible for determining the value of donated goods and whether a contribution qualifies for a tax deduction. Frugal Coyote does not provide tax, legal, or appraisal advice.

9. Monetary Donations

All contributions must be made using an authorized payment method. Unless otherwise stated or required by law, completed donations are final and nonrefundable.

 

Frugal Coyote will make reasonable efforts to honor an expressly accepted restriction on a contribution. If fulfilling that restriction becomes impossible or impractical, we may contact the donor or use the funds in a manner consistent with the organization’s charitable mission and applicable law.

10. Website Content and Intellectual Property

The Site and its text, graphics, photographs, logos, design elements, and other original content are owned by or licensed to Frugal Coyote and are protected by applicable intellectual-property laws.

 

You may view, download, or print Site content for personal, noncommercial use. You may not reproduce, modify, sell, publish, distribute, or commercially exploit Site content without prior written permission.

11. Third-Party Websites and Services

The Site may link to social media platforms, payment processors, maps, or other third-party services. Frugal Coyote does not control and is not responsible for third-party content, availability, security, or privacy practices.

 

Links are provided for convenience and do not necessarily represent an endorsement. Your use of a third-party service is governed by that provider’s terms and policies.

 

12. Informational Content

Information on the Site is provided for general informational purposes. Although we try to keep it current, store hours, merchandise, services, events, donation guidelines, and other details may change without notice.

 

Nothing on the Site constitutes legal, tax, financial, appraisal, medical, or other professional advice.

 

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as available” basis. Frugal Coyote does not guarantee that the Site will always be uninterrupted, secure, error-free, or free from harmful components.

 

These disclaimers do not affect warranties or consumer rights that cannot be limited under applicable law.

 

14. Limitation of Liability

To the fullest extent permitted by law, Frugal Coyote and its directors, officers, employees, volunteers, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of—or inability to use—the Site.

 

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

16. Changes to the Site or These Terms

We may update the Site or these Terms periodically. Revised Terms will be posted on this page with a new effective date. Your continued use of the Site after an update constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any legal proceeding concerning these Terms will be brought in a court with appropriate jurisdiction in San Diego County, California, unless applicable law requires otherwise.

 

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed to the minimum extent necessary. The remaining provisions will remain in effect.
